1. Agreement to Terms

Welcome to Shikshart! These Terms of Service ("Terms") constitute a legally binding agreement between you and Sahind Technologies Pvt. Ltd. ("Company", "we", "us", or "our"), governing your access to and use of the Shikshart platform, including our website at shikshart.com and all related services.

By accessing or using Shikshart, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.

2. Eligibility

To use Shikshart, you must:

• Be at least 18 years of age
• Be capable of forming a binding contract under applicable Indian law
• Not be prohibited from using our services under any applicable law
• Provide accurate and complete registration information

If you are using Shikshart on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

When you create an account on Shikshart:

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You may not transfer your account to another person without our written consent

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Services Description

Shikshart provides:

• Program Marketplace: Discovery and enrollment in startup programs, accelerators, and bootcamps
• Mentor Network: Connection with experienced mentors for 1-on-1 guidance
• Job Portal: Job listings at startups and entrepreneurial opportunities
• Community: Forums, events, and resources for the startup ecosystem
• Learning Resources: Educational content, templates, and guides

We act as a marketplace platform connecting users with programs, mentors, and opportunities. We are not responsible for the quality, safety, or legality of services provided by third parties on our platform.

5. User Responsibilities

As a user of Shikshart, you agree to:

• Use the platform only for lawful purposes
• Not post false, misleading, or fraudulent content
• Not harass, abuse, or harm other users
• Not attempt to gain unauthorized access to our systems
• Not use automated systems to access the platform without permission
• Not infringe on the intellectual property rights of others
• Not use the platform to spam or send unsolicited communications
• Comply with all applicable Indian laws and regulations

6. Payments and Fees

6.1 Payment Terms

• All prices are listed in Indian Rupees (INR) unless otherwise specified
• Payments are processed through secure third-party payment processors
• You agree to pay all fees associated with your purchases
• Prices may change at our discretion with reasonable notice

6.2 Taxes

All fees are exclusive of applicable taxes (including GST). You are responsible for paying any applicable taxes on your purchases.

6.3 Platform Commission

Shikshart charges a platform fee for facilitating transactions between users and service providers. The applicable fee structure is disclosed at the time of transaction.

7. Intellectual Property

The Shikshart platform, including its design, logo, content, and features, is owned by Sahind Technologies Pvt. Ltd. and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks without written authorization
• Reverse engineer or attempt to extract source code
• Create derivative works based on our platform

Content you submit to Shikshart remains yours, but you grant us a license to use, display, and distribute it in connection with our services.

8. Disclaimers

SHIKSHART IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

• Uninterrupted or error-free service
• The accuracy or completeness of information on the platform
• The quality of services provided by third parties
• Specific outcomes from using our platform

We are not responsible for the actions, content, or conduct of third parties, including mentors, program providers, and other users.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAHIND TECHNOLOGIES PVT. LTD. SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from third-party services on our platform

Our total liability for any claims related to the platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Sahind Technologies Pvt. Ltd., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the platform

11. Termination

We may suspend or terminate your account at any time for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• At your request

Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of Shikshart shall be resolved through:

• Good faith negotiation between the parties
• Mediation, if negotiation fails
• Binding arbitration in accordance with the Arbitration and Conciliation Act, 1996

The seat of arbitration shall be New Delhi, India, and proceedings shall be conducted in English.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the platform or by email. Your continued use of Shikshart after such changes constitutes acceptance of the updated Terms.
