These terms of service ("terms") constitute a legally binding agreement between the user and shikshart. we governing access to and usage of our digital infrastructure, learning management systems, and associated service layers. by accessing our platform, you acknowledge and consent to the following terms, conditions, and compliance frameworks.

1. service access & usage parameters

a. authentication & credentialing
access to restricted services necessitates multi-factor authentication (mfa) and cryptographically secure user verification. any unauthorized credential propagation, token sharing, or circumvention of authentication layers constitutes a violation of service terms.

b. data exchange & transactional interfacing
users engaging in enrollment, course participation, or financial transactions are subject to real-time integrity checks, tokenized payment processing, and role-based access control (rbac) enforcement. anomalous activity triggers automated security audits and potential service restrictions.

c. license & content utilization
shikshart grants a non-exclusive, revocable, non-transferable license for personal, educational use of its proprietary content, subject to digital rights management (drm) enforcement. reverse engineering, unauthorized replication, or circumvention of access control mechanisms is strictly prohibited.

2. user obligations & conduct

a. acceptable use policy (aup)
users shall not:

• deploy automated scripts, crawlers, or botnet-driven interactions that induce excessive system load

• engage in data scraping, injection attacks, or vulnerability exploitation

• manipulate, redistribute, or sublicense proprietary content beyond licensed scope

• transmit malicious code, phishing payloads, or cryptographic exploits via our infrastructure
  violations may result in account termination, blacklisting, and legal recourse under applicable cyber laws.

b. data privacy & compliance
all interactions are subject to our privacy policy, and data processing adheres to encryption-at-rest (aes-256) and encryption-in-transit (tls 1.3) protocols. users retain control over their personally identifiable information (pii) as delineated under data protection statutes.

3. payment processing & subscription models

a. transactional framework
financial interactions utilize pci-dss-compliant payment gateways. subscription models may include:

• one-time transactions – course-based purchases with no auto-renewal

• recurring subscriptions – auto-billed learning memberships with defined renewal cycles

• enterprise licensing – custom institutional access governed by separate contractual agreements

b. refund & dispute resolution
refund eligibility is contingent upon predefined conditions such as course completion thresholds and content access timestamps. chargeback abuse, fraudulent disputes, or unauthorized payment reversals may result in permanent account suspension and collection of outstanding balances.

4. intellectual property & content restrictions

all source code, pedagogical frameworks, ui/ux elements, machine learning models, and proprietary datasets within shikshart’s ecosystem remain the exclusive intellectual property of shikshart. unauthorized modification, decompilation, mirroring, or derivative work creation is strictly prohibited.

5. service availability & system uptime

we employ redundant cloud architectures, auto-scaling protocols, and real-time failover mechanisms to maintain service uptime. however, unplanned downtimes due to force majeure, zero-day exploits, or upstream provider failures may occur. users acknowledge that uninterrupted service availability is not explicitly guaranteed.

6. limitation of liability & indemnification

shikshart assumes no liability for indirect, incidental, or consequential damages arising from:

• service disruptions – unforeseen outages, ddos events, or platform maintenance

• data loss – corruption due to third-party integrations, unauthorized access, or user error

• legal & regulatory compliance – user-initiated infractions of jurisdictional laws
  users agree to indemnify and hold shikshart harmless against claims, losses, or legal actions resulting from violations of these terms.

7. modifications & policy amendments

shikshart reserves the right to modify these terms at its discretion. users will be notified of significant amendments via in-platform notifications or registered email communications. continued usage post-update constitutes acceptance of revised terms.

8. governing law & dispute resolution
